CAFP Community Guidelines
Thank you for being part of SPARK, the online community of the California Academy of Family Physicians (CAFP). To ensure the best possible experience for all members, we have established some basic guidelines for participation.
We welcome your comments and encourage thoughtful discussion and differing viewpoints. Feel free to challenge the ideas of those with whom you disagree, but please be respectful.
CAFP reserves the right (but assumes no obligation) to remove comments that are racist, sexist, abusive, profane, violent, obscene, or that libel, incite, threaten, make personal attacks, or otherwise fail to comply with CAFP Community Guidelines or Terms of Service.
In addition, we will not permit messages selling products, recruiting, political campaigning or endorsements, or promoting commercial or other ventures, or those perceived as spam. The posting of volunteer positions is not, however, prohibited under these Guidelines.

DISCLAIMER AND INDEMNITY
CAFP has provided this online community for the convenience of CAFP members, staff and certain other authorized individuals. CAFP Communities are provided as a forum for enabling participants to communicate about subjects of interest. CAFP does not exert editorial control over information or materials posted by third parties onto CAFP Communities or information or materials that are emailed by third parties to any other parties. CAFP is not responsible for monitoring any materials posted by any third party or for verifying that such information or materials are accurate, timely, reliable, suitable, complete, non-infringing or free from technical defects.
CAFP accepts no responsibility for, and expressly disclaims all warranties and representations of any kind, express or implied, regarding, the use, operation or performance of the online community or any information or materials posted through any CAFP Community, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
In no event shall CAFP be liable for any direct, indirect, punitive, incidental, special, consequential or any other damages whatsoever arising out of or in any way connected with (l) the use, operation or performance of any CAFP Community, (2) the delay or inability to use any CAFP Community in whole or in part, (3) any reliance by you on information or materials provided on or through any CAFP Community or on the reliability, accuracy, completeness, suitability or timeliness thereof, (4) any unauthorized use by you or others of any CAFP Community, or (4) termination or modification by CAFP of any CAFP Community or any information or materials provided thereon , whether based on contract, tort, negligence, strict liability or otherwise, even if CAFP has been advised of the possibility of such damages.
In addition to and without limiting the foregoing, CAFP shall not be liable for any harm caused by the transmission, via use of any CAFP Community, of a computer virus, or other computer code or programming device that might be used to access, modify, delete, damage, corrupt, deactivate, disable, disrupt, or otherwise impede, in any manner, the operation of any of your software, hardware, data or property.
You are solely responsible for the content of any content you post to any CAFP Community and you agree to indemnify and hold CAFP, its affiliates, officers, agents and employees, harmless from any claim, demand or expense (including attorneys' fees) due to or arising out of your use of any CAFP Community or of any information or materials provided via any CAFP Community.
GUIDELINES
Only information which can be expected to be of interest to CAFP members by virtue of its relevance to either (1) clinical and socioeconomic issues in medicine or (2) CAFP related activities should be posted.
Do not post any false, inaccurate, misleading, defamatory, tortuous, abusive, threatening, harassing, profane, obscene, offensive, pornographic, hateful, infringing, anti-competitive or illegal information or materials.
CAFP does not condone and will not be responsible for any such information or materials or for any resulting liability. Any communications regarding salaries or pricing (including negotiations with payers) are prohibited.
Do not post commercial or promotional messages. In fairness to your community, if you have an economic interest in any product or service, you should mention your relevant interest or affiliation when posting about or otherwise discussing that product or service (or the product or service of a competitor). All community participants deserve to know this information so that they can make their own determination whether another participant’s background or affiliation colors that person’s remarks.
Do not post any information, software or other material protected by copyright, patent, trademark, trade secret or other proprietary right without the permission of the rights owner. By posting information, software or other material, the posting party warrants and represents that it owns such rights in the information, software or other material, or has received permission from the person or entity who owns such rights, in the information, software or other material. By posting information, software or other material, the posting party grants CAFP and other subscribers to CAFP Communities the non-exclusive right and license to display, copy, publish, distribute, transmit, print and use such information, software or other material. Subject to the grant of this license, the posting party retains any other rights that the party may have in such information, software or other material.
Do not post any information or materials which contain any virus, Trojan horse, corrupted file, worm, time bomb, cancelbot or other computer programming routine that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.
Do not post any information or materials, which contain personal health information as defined by HIPAA. Online community participants should be familiar with HIPAA privacy and security standards and review all information prior to submission to avoid inadvertent disclosure.
Specific mentions of fees and prices should not be made, nor should any proposal that physicians act together in a way where pricing or participation are concerned.
CAFP accepts no responsibility for the opinions and information posted by users. CAFP does not actively monitor the communities for inappropriate postings and does not, on its own, undertake editorial control of postings. However, in the event that any inappropriate posting is brought to CAFP's attention, CAFP has the right, but not the obligation, to remove all or part of the posting and/or terminate a user's access to CAFP Communities. CAFP reserves the right to reveal your identity (or whatever information it may know about you) in the event of a complaint or legal action arising from any content posted by you.
CAFP may modify, suspend or discontinue, on a temporary or permanent basis, any CAFP Community service at any time for any reason. All rights of termination shall be within the sole discretion of CAFP.
As CAFP Communities are not regularly monitored by CAFP, do not use them to send messages to CAFP staff. Email can be sent to CAFP via cafp@familydocs.org.
